
1. Introduction
Welcome to WPS LifeStage Money, a subscription-based mobile application (“App”) provided by WPS Advisory Limited (“we”, “us”, or “our”), an Independent Financial Adviser authorised and regulated by the Financial Conduct Authority (FCA) (Financial Services Register Number: 624546). These Terms and Conditions (“Terms”) govern your use of the App, which provides financial information, access to a white-labelled insurance quotation service for car and home insurance, and guidance on switching utility providers. By downloading, accessing, or using the App, you agree to be bound by these Terms, our Privacy Policy, and any applicable terms of third-party services linked through the App (collectively, the “App Agreement”). If you do not agree, you must not use the App.
2. Company Information
WPS Advisory Limited is registered in England & Wales under Company Number 08874015. Our registered office is: Suite A, 5th Floor, West One, Newcastle upon Tyne, NE1 3PA. We are accredited to ISO 27001 (information security management), ISO 27701 (privacy information management), and ISO 9001 (quality management) standards, ensuring robust security, privacy, and service quality.
3. Services Provided
3.1 Financial Information
The App provides general financial information for educational purposes only, including content from third-party integrations that supply information only. This information is not personalised financial advice and should not be relied upon as such. You should consult with one of our qualified financial advisers for tailored advice. The App requires an active internet connection for all features. No offline functionality is available.
3.2 Insurance Quotation Service
The App includes links to a white-labelled insurance quotation service (eg for car and home insurance), operated by QuoteZone. We act as an introducer, connecting you to this service. We do not provide advice or recommendations on general insurance products. Any general insurance contract you enter into is between you and the insurer.
3.3 Utility Switching Guidance
The App provides guidance on switching utility providers to identify lower-cost offerings, facilitated through a white-labelled service operated by PayLow. We act as an introducer and do not provide advice on utility contracts.
3.4 Introducer Role and Remuneration
We may receive remuneration from third-party providers, including QuoteZone and PayLow, for each click-through from the App that results in a sale. This remuneration does not affect the price you pay and is disclosed in accordance with FCA rules (ICOBS 4.6). You can request details of our earnings by contacting us at support@ukwps.com.
4. Subscription and Payment
4.1 Subscription Fees
The basic subscription level is £5 per employee/user per month (excluding VAT), with additional, more expensive tiers available for enhanced features, as displayed at the time of subscription. All fees include applicable taxes, such as VAT, as required by UK law.
4.2 Payment Terms
Payments are processed securely via the Apple App Store or Google Play Store. You must provide valid payment details and authorise us to charge the subscription fee. If payment fails, we may suspend your access until payment is received.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through the App’s settings or by contacting us at support@ukwps.com. No refunds are provided for partial subscription periods, except where required by law (e.g., under the Consumer Contracts Regulations 2013, you have a 14-day cooling-off period for digital services if you are a consumer).
4.4 Digital Receipts
Payments are processed via the Apple App Store or Google Play Store, which issue digital receipts to your registered email or app account.
5. User Eligibility and Account Responsibilities
5.1 Eligibility
To use the App, you must be at least 18 years old, a UK resident, and legally capable of entering into a binding contract under UK law. By using the App, you confirm you meet these requirements.
5.2 Account Creation
To access the App, you must create a user account (“User Account”) with a valid email address, username, password, and other required information. You must keep your login credentials confidential and not share them with third parties.
5.3 User Responsibilities
– Accuracy: You are responsible for ensuring the accuracy and completeness of information provided through the App, including for insurance quotations or utility switching.
– Security: You must notify us immediately at support@ukwps.com if you suspect unauthorised access to your User Account or the App.
– Access: You are responsible for maintaining internet access and compatible devices to use the App.
– Prohibited Use: You must not use the App for unlawful purposes, to mislead third parties, or in a way that violates these Terms (e.g., hacking, transmitting malicious code).
– Device Requirements: The App is supported by Apple iOS 15.1 and later versions, and Android 7.0 and later versions. We are not responsible for issues arising from unsupported devices or operating systems.
– Two-Factor Authentication: Two-factor authentication (2FA) is required for App access to enhance security. You are responsible for maintaining the security of 2FA methods (e.g., authenticator apps, SMS codes).
6. Data Access and Privacy
6.1 Data Access
By using the App, you grant us and our technology partner, Moneyhub, permission to access and process your financial data to provide the App’s services. No personal data is transferred from the App to QuoteZone, PayLow, or other third-party services when you access their links. Any data you provide on their sites is subject to their respective privacy and cookie policies.
6.2 Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and ISO 27701 standards. You may withdraw consent for data access at any time by contacting us at support@ukwps.com, though this may limit App functionality.
6.3 Data Security
We implement appropriate technical and organisational measures, aligned with ISO 27001 standards, to protect your data. However, we cannot guarantee the security of data transmitted over mobile networks, which you use at your own risk.
6.4 Push Notifications
We do not currently send push notifications. By using the App, you consent to receive push notifications in the future, including non-marketing (e.g., service updates, subscription reminders, security alerts) and marketing notifications (e.g., product offers), which you can manage or disable at any time.
7. Regulatory Compliance
7.1 FCA Authorisation
We are authorised and regulated by the FCA for insurance distribution activities. Our activities as an introducer are subject to the FCA’s Insurance Conduct of Business Sourcebook (ICOBS) and Principles for Businesses (PRIN).
7.2 Insurance Distribution
When linking to the insurance quotation service, we comply with ICOBS requirements, including:
– Providing clear, fair, and not misleading information (ICOBS 2.2).
– Disclosing our role as an introducer and any remuneration received (ICOBS 4.6).
– Ensuring the service meets your demands and needs, where applicable (ICOBS 5.2).
7.3 Consumer Duty
We adhere to the FCA’s Consumer Duty (PRIN 12), ensuring our services deliver good outcomes for retail customers by acting in good faith, avoiding foreseeable harm, and enabling customers to pursue their financial objectives.
7.4 Utility Switching
Guidance on utility switching is provided through a third-party service compliant with Ofgem’s Confidence Code. We act as an introducer and do not provide regulated (utility switching) advice.
8. Third-Party Services
8.1 White-Labelled Services
The insurance quotation service (operated by QuoteZone) and utility switching service (operated by PayLow) are provided by third parties. Other third-party integrations provide information only and do not involve data transfer from the App. We are not responsible for the accuracy, reliability, or outcomes of these services. Any contracts you enter into are with the third-party provider, governed by their terms. When you access QuoteZone or PayLow’s services, their privacy and cookie policies apply.
8.2 Links to Third-Party Sites
The App contains links to third-party websites, including QuoteZone and PayLow. We are not responsible for their content, privacy practices, or availability. You access them at your own risk.
9. Limitation of Liability
9.1 General
The App and its services are provided “as is” and “as available.” We use reasonable skill and care but do not guarantee uninterrupted or error-free operation.
9.2 Liability Exclusions
To the extent permitted by law, we are not liable for any loss or damage arising from:
– Use of third-party services or websites linked through the App.
– Defects, viruses, or malfunctions caused by your device or network.
– Unauthorised access to your User Account due to your failure to secure credentials.
– Service unavailability due to maintenance, network issues, or events beyond our control.
9.3 Exclusions Not Affected
Nothing in these Terms excludes or limits our liability for:
– Death or personal injury caused by our negligence.
– Fraud or fraudulent misrepresentation.
– Obligations under the Financial Services and Markets Act 2000.
– Any liability that cannot be excluded under UK law (e.g., Consumer Rights Act 2015).
10. Changes to Terms
We may update these Terms to reflect changes in law, regulation, or our services. We will notify you of material changes via email, the App, or our website at least 30 days in advance. This is version 1 of these Terms. A change log is not currently available but will be maintained at https://lifestageadvice.com/terms-history for future updates. By continuing to use the App after notification, you accept the updated Terms.
11. Termination
11.1 By Us
We may suspend or terminate your access to the App if you breach these Terms, without prior notice or liability. If the breach can be remedied, we will provide a reasonable opportunity to do so.
11.2 By You
You may terminate your use of the App by deleting your User Account and removing the App from your devices.
11.3 Account Dormancy
Your User Account becomes dormant when your subscription ends. We may suspend or delete dormant accounts to protect your data, notifying you via email to allow reactivation.
11.4 Post-Termination
Upon termination, you must cease using the App and delete all copies from your devices. We may remotely disable access to the App.
12. Complaints and Disputes
12.1 Complaints
If you have a complaint, contact us at complaints@wpsadvisory.com. We will handle complaints promptly and fairly in line with FCA rules (DISP 1). If you are not satisfied and are an eligible complainant, you may refer your complaint to the Financial Ombudsman Service (FOS) at www.financial-ombudsman.org.uk.
12.2 Disputes
Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by law (e.g., for consumers in Scotland or Northern Ireland).
13. Intellectual Property
All intellectual property rights in the App, including software, content, and branding, belong to us or our licensors. You are granted a non-exclusive, non-transferable license to use the App for personal purposes only, subject to these Terms.
14. General
14.1 Governing Law
These Terms are governed by English law.
14.2 Third-Party Rights
No person other than you and us has rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.
14.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
